Legal responsibility of podcasters in Indonesia: Analysis of the legal vapor in digital broadcasting

Podcasts, as a form of digital broadcasting, enable the public to produce and distribute content without spatial or temporal limits. However, such activities lack a clear legal foundation within Indonesia’s broadcasting system. This study employs a normative juridical approach to examine the legal vacuum and podcasters’ responsibility for their content. The findings show that podcasts are not categorized as broadcasting under Law No. 32 of 2002, while the application of the Electronic Information and Transactions Law (ITE Law) remains substitutive and creates legal uncertainty. Therefore, a lex specialis regulation is needed to ensure legal clarity, technological adaptability, and a balance between freedom of expression and accountability.
